Church of Gaia Becomes First to Receive DEA-Approved Religious Exemption for Ayahuasca Use

In a historic moment for plant medicine and spiritual freedom in the United States, the Spokane-based Church of Gaia has officially received a federally recognized religious exemption from the Controlled Substances Act (CSA) — the first of its kind ever approved under the Religious Freedom Restoration Act (RFRA).

After filing their petition in September 2022, the Church's leadership and legal team have spent the past two and a half years in careful negotiations with the DEA. As of today, all signatures have been completed and the agreement finalized, allowing the Church to legally import and brew Ayahuasca for use in sacred religious ceremonies.

 
While petitions under RFRA have existed since 2009, none have ever been approved — until now,” shared Church leaders. “We are honored to be part of this breakthrough moment.
 

This exemption makes the Church of Gaia one of a select few organizations in the United States with legal permission to use Ayahuasca in spiritual practice. Unlike other groups that have secured permissions through litigation or settlements, this exemption represents a landmark legal agreement based on religious freedom.

What’s Next for the Church of Gaia?

While the legal milestone marks a huge success, the work is far from over. With warmer months ahead, the Church is turning its attention to building out ceremonial grounds, completing road access, and erecting a large ceremonial yurt.
